1. INTRODUCTION AND ACCEPTANCE

These Terms of Service ("Terms") govern your use of EazyData analytics services provided by GOD OF PROMPT OÜ. By accessing or using our Services, you agree to be bound by these Terms. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICES.

2. SERVICE DESCRIPTION

EazyData provides privacy-focused web analytics including cookieless visitor tracking, revenue and customer journey analytics, payment provider integrations (Stripe, PayPal, Shopify, Lemon Squeezy), dashboard access and data visualization, and API access for data retrieval.

3. ACCOUNT AND USER OBLIGATIONS

3.1 Account Requirements

You must be 18+ years old
Provide accurate registration information
Maintain security of your account credentials
Notify us immediately of unauthorized access

3.2 Acceptable Use

You may ONLY use the Services for:

Tracking analytics on websites you own or control
Legitimate business intelligence purposes
Compliance with all applicable laws

3.3 Prohibited Activities

Collect personally identifiable information beyond basic analytics
Use Services for illegal, fraudulent, or malicious purposes
Reverse engineer or redistribute our Services
Interfere with or disrupt the Services
Violate data protection laws (GDPR, CCPA, PECR)
Track users without proper legal basis

4. PRICING AND PAYMENT

4.1 Subscription Fees

$7 USD/month for up to 10,000 events
Billed monthly in advance
Processed through third-party payment processors

4.2 Free Trial

14-day free trial for new customers. No credit card required during trial.

4.3 Refund Policy

All sales are final after the trial period. No refunds for partial months or unused services. Technical issues: contact support immediately.

4.4 Overages: Email notification if you exceed plan limits. Service may be suspended until plan upgrade; overage fees may apply.

4.5 Late Payment: Account suspension after failed payment attempts. Late fees and collection costs may apply.

5. DATA OWNERSHIP AND PRIVACY

5.1 Your Data Ownership: You retain all rights to data collected through the Services ("Customer Data").

5.2 Data Processing Role: You are the data controller; we are the data processor acting on your behalf.

5.3 Privacy Compliance: We comply with EU GDPR, Estonian Personal Data Protection Act, ePrivacy Directive, and CCPA.

5.4 Data Security: HTTPS/TLS encryption in transit, EU-based server storage only, regular security audits, access controls.

5.5 Data Location: All data stored in EU servers and never leaves EU jurisdiction.

5.6 Data Retention: Retained while account is active; deleted within 30 days of account termination. Aggregated anonymous data may be retained indefinitely.

5.7 Data Export: Export your data anytime via CSV or API.

6. INTELLECTUAL PROPERTY

6.1 Our IP: All Services, software, designs, and content are owned by GOD OF PROMPT OÜ and protected by intellectual property laws. 6.2 Restrictions: You may not copy or modify our Services, use our trademarks without permission, or remove proprietary notices. 6.3 Feedback: Feedback you provide may be used by us without compensation.

7. WARRANTIES AND DISCLAIMERS

7.1 Limited Warranty: Services will perform substantially as documented. 7.2 DISCLAIMER: SERVICES PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND INCLUDING MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR RELIABILITY. We don't warrant error-free or uninterrupted service.

8. LIMITATION OF LIABILITY

8.1 Excluded Damages: We are NOT liable for indirect, incidental, or consequential damages, or for loss of profits, revenue, data, business interruption, or goodwill.

8.2 Liability Cap: Our total liability is limited to the lesser of fees paid in the prior 12 months or €100.

8.3 Exceptions: Nothing limits liability for death or personal injury from negligence, fraud or fraudulent misrepresentation, or matters that cannot be excluded by law.

9. INDEMNIFICATION

You agree to indemnify and hold harmless GOD OF PROMPT OÜ from claims arising from your use of the Services, your violation of these Terms, your violation of laws or third-party rights, or your data protection law breaches.

10. TERM AND TERMINATION

10.1 Termination by You: Cancel anytime through account settings or by contacting us. Effective at end of billing period.

10.2 Termination by Us: We may terminate immediately if you breach these Terms, engage in fraudulent or illegal activities, or pose security or legal risks.

10.3 Effect of Termination: Access ceases immediately, unpaid fees remain due, data deleted within 30 days, you must remove our tracking script.

11. DISPUTE RESOLUTION

11.1 Governing Law: Estonian law governs these Terms.

11.2 Jurisdiction: Exclusive jurisdiction of Estonian courts.

11.3 Negotiation: Contact us for 30 days to resolve disputes amicably before legal action.

12. GENERAL PROVISIONS

12.1 Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement.

12.2 Modifications: We may update Terms with notice. Continued use means acceptance.

12.3 Severability: Invalid provisions don't affect remaining Terms.

12.4 No Waiver: Failure to enforce doesn't waive our rights.

12.5 Assignment: You cannot assign; we may assign to affiliates or in M&A.

12.6 Force Majeure: Not liable for failures beyond our reasonable control.

13. EU VAT (BUSINESS CUSTOMERS)

Prices exclude VAT unless stated. Provide valid VAT number. Reverse charge may apply for intra-EU B2B. You may need to self-account for VAT.
